【背景】

最高人民法院、最高人民检察院、公安部、司法部、海关总署16日联合发布《关于进一步加强国境卫生检疫工作 依法惩治妨害国境卫生检疫违法犯罪的意见》。根据这份意见，检疫传染病染疫人或者染疫嫌疑人拒绝隔离、不如实填报健康申明卡等，可按妨害国境卫生检疫罪定罪处罚。

People who do not report truth about their infectious diseases or falsify their health statement cards when entering the country will be identified as disturbing border health and quarantine in accordance with Chinese criminal law.

依据我国刑法，入境时瞒报传染性疾病、不如实填报健康申明卡者，可按妨害国境卫生检疫罪定罪处罚。

infectious diseases是传染性疾病。
最高人民法院（the Supreme People's Court）、最高人民检察院（the Supreme People's Procuratorate）、公安部（Ministry of Public Security）、司法部（Ministry of Justice）、海关总署（Central Administration of Customs）16日联合印发相关意见，明确这一罪名。
《意见》旨在进一步加强国境新型冠状病毒（novel coronavirus）的卫生检疫工作（health and quarantine work），更有效地依法保障公共卫生安全（keep public health secure）。
除伪造健康信息（health information）外，《意见》还明确了依据刑法（in accordance/line with the Criminal Law）认定妨害国境卫生检疫罪（disturb border health and quarantine）的几种情形。
举例来说，拒绝执行海关提出的健康检查（health checks）、或隔离要求（quarantine orders）的；或来自检疫传染病流行国家、地区的出入境交通工具（exit-entry public transport）上出现非意外伤害死亡（non-accidental deaths）且死因不明的人员，交通工具负责人故意隐瞒情况的，将面临类似的刑事指控（criminal charge）。
《中华人民共和国刑法》第三百三十二条规定：“ 违反国境卫生检疫规定， 引起检疫传染病传播（cause spread of the infectious disease）或者有传播严重危险的，处三年以下有期徒刑或者拘役（a maximum sentence of three years in prison or detention），并处或者单处罚金（fines）。
