全国人大常委会近日表决通过的《刑法修正案（八）》规定依法实行社区矫正，这一概念首次被写入刑法。

社区矫正近日被载入《刑法修正案（八）》，成为惩罚罪犯的一种方式，并将于5月1日起开始实施。

上述报道中的community correction就是“社区矫正”，是一种不使罪犯与社会隔离并利用社区资源教育改造罪犯的方法，是non-jail punishment（非监禁刑）的一种。较常见非监禁刑的包括reprieve（缓刑）、release on parole（假释）、community service（社区服务）、halfway house/recovery house（为长期监禁人员开设的重返社会训练所）等。

社区矫正适用的罪犯有以下几种：criminals who commit light offenses（罪行轻微的）、在狱中表现良好的、以及在特定条件下 executing sentences out of jail（监外服刑）的罪犯等。
